Involuntary leave without pay.  Can be used for an employee who is vested with CalPERS but is unable to perform the duties of his/her position or any other position within the university due to disability. During the time CalPERS is reviewing the disability retirement application for determination, the employee may be using leave credits, Industrial Disability Leave (IDL) or Non-Industrial Disability Insurance (NDI) payments, as appropriate, or, in some circumstances, may not be receiving any type of pay.

General Information:
  • Use LOA/INV in the leave instance where the employee is not receiving pay.  For additional information, refer to Technical Letter HR/Benefits 2004-29.

  • Do not post any action/reasons while the employee is on a leave without pay. (Position changes are permitted.) Always refer to technical letters/HR letters for instructions on processing salary related actions.

  • While on a LWOP the class code cannot be changed unless:

 -prompted by reorganization changes where the job code is no longer appropriate, or
 - the employee was officially notified of actions in progress (e.g. promotion, demotion) prior to the effective date of the LWOP or per a side letter of agreement that requires the employee to vacate a classification.

  • If a change is required per any of the above, process a RFL/LOA to return the employee from leave, then process a POS/UPD to change the position, followed by a LOA/INV (BOB) with the same effective date as the POS/UPD.

  • Complete effective date as follows:

 -If the employee elected to not use available leave credits and not participate in any eligible leave benefit programs, the effective date of the LWOP is the date the disability retirement application is made for the employee.
 -If the employee exhausted all leave credit/benefit programs and is to receive full TDA pay, the effective date of the LWOP is the date the leave credits are exhausted or the eligible leave benefit program ends. Note: Process the appropriate Return from Disability (RFD) action to return the employee from the leave benefit before processing the LOA/INV.
 -If the leave of absence for a faculty employee (AY), 8/12, 10/12, or 11/12 employee is effective mid-month and the employee has dock days prior to the effective date of the leave, enter the number of days to be paid in Item 606. Do not process a F603 dock notice.
 -If an employee is entitled to a SSI or promotion effective with the beginning of a pay period or the beginning of a new fall/spring semester/quarter, process the PAY/SSI or PRO/PRO first, followed by the LOA/INV with the same effective date; enter ’BOB’ in Item 210 of the LOA/INV.

  • If an employee's disability is denied and a LOA/INV was processed, void the LOA/INV transaction and any subsequent transactions as needed to return the employee to their prior status. In addition, if the employee received partial TDA payments with leave benefit program payments, post a DTA/EHR effective the date the involuntary leave started and enter 'ON IL RET DENIED'.
